Participant Release & Agreement

This Release and Agreement (“Release”) for participation in the BPM (the “Course”) sets out the conditions under which Capacity Creator Corp. (“Capacity Creator”), will facilitate the BPM and it releases Capacity Creator and each of its staff, volunteers, other participants and sponsors. The Participant desires to access and participate in the BPM.

  1. Waiver and Release: I, the Participant, release and forever discharge and hold harmless Capacity Creator and its staff, volunteers, other participants and sponsors from any and all liability, claims, and demands of whatever kind or nature, either in law or equity, which may arise or hereafter arise from my participation in the BPM including, but not limited to, personal injury or illness that may result from the services provided by Capacity Creator or occurring while I am participating in the BPM including, but not limited to heightened emotional or physical sensations, agitation and headaches due to the nature of the BPM which includes discussion of mental health matters.
  • Acknowledgement of Personal Responsibility: I acknowledge that the information provided through the BPM is not intended to be a substitute for professional advice that can be provided by my own academic advisors. Capacity Creator is not giving career or legal advice in any way. I agree that Capacity Creator is not responsible for any result of any kind that I may or may not have as a result of information presented through the BPM. I am solely responsible for my own results.
  • Acknowledgment of Prohibitions: I acknowledge that I am expressly prohibited from doing any of the following:
  • copy, share, sell or otherwise distribute the BPM or any parts of it without the express written permission of Capacity Creator;
    • use the BPM or any parts of it or any derivative content to consult with or educateany other person, firm, corporation, or other entity;
    • use, copy, adapt or represent the BPM or its content in any way as if they are the property or creation of the Participant;
    • violate the intellectual property rights of Capacity Creator, including copyright and trademark rights, by downloading, printing, or otherwise using the BPM for publication or compilation into a Course or publication of the Participant, products or services for Participant’s own personal, business or commercial use whether such use earns Licensee money or not;
    • assign, pledge, sublicense or otherwise transfer the licence granted to the Participant to anyone else without the express prior written permission of Capacity Creator; or
    • engage in any other improper or unauthorized use of the BPM as set out more fully in the Licensing Agreement.

As a Participant, I expressly agree that this Release is intended to be as broad and inclusive as permitted by the laws of the Province of Ontario and that this Release shall be governed by and interpreted in accordance with the laws of the Province of Ontario. I agree that in the event any clause or provision of this Release is deemed invalid, the enforceability of the remaining provisions of this Release shall not be affected.

BY ACCEPTING THE TERMS, I WARRANT THAT I AM 18 YEARS OF AGE OR OLDER, AND I HAVE READ AND I UNDERSTAND THE RELEASE AND CONSENT. I UNDERSTAND THAT THIS DOCUMENT CONTAINS A PROMISE NOT TO SUE CAPACITY CREATOR CORP. OR MELANIE SODKA AND THAT IT CONSTITUTES A RELEASE OF LIABILITY AND AN INDEMNITY FOR ALL CLAIMS.
